1. General
1.1. These Terms and Conditions ("AGB") govern the contractual relationship between Malters-Mobility.ch (hereinafter "Lessor") and the respective customer (hereinafter "Lessee") for the rental of vehicles.
1.2. By signing the rental agreement or confirming an online booking, the Lessee accepts these Terms and Conditions.
1.3. Deviating terms proposed by the Lessee are not recognised unless the Lessor expressly agrees to them in writing.
2. Subject matter of the contract
2.1. The Lessor provides the Lessee with the contractually agreed vehicle for the agreed period.
2.2. Handover and return of the vehicle take place at the agreed location and time.
2.3. The vehicle is handed over to the Lessee in a roadworthy, operational and clean condition. Any pre-existing damage is recorded in the handover report (damage list, appendix 8.2 of the rental agreement).
3. Rental prices and payment terms
3.1. Rental prices are based on the price list valid at the time of rental, published on the Malters-Mobility.ch website.
3.2. The rental price includes the mileage stated in the rental agreement. Additional mileage is charged according to the price list.
3.3. Payment is made by credit card, bank transfer or cash. The rental price and deposit must be received in full by the Lessor before vehicle handover at the latest; without full payment there is no entitlement to vehicle handover.
3.4. In the event of cancellation by the Lessee, the following cancellation terms apply:
- At least 7 calendar days before rental start: full refund
- 3 to 6 calendar days before rental start: 50% refund
- Less than 3 calendar days before rental start: no refund
3.5. In the event of an extension of the rental period, the Lessee must inform the Lessor in a timely manner; an extension is only deemed agreed once confirmed in writing by the Lessor, and the additional rental fee must be paid.
4. Deposit
4.1. A deposit is due at vehicle handover. The amount and payment method of the deposit are set out in the respective rental agreement.
4.2. The deposit is refunded after proper return of the vehicle and deduction of any costs for damage, extra mileage or cleaning, at the latest within three business days after return and inspection of the vehicle.
4.3. The Lessor reserves the right to withhold the deposit in whole or in part if the Lessee breaches the provisions of the rental agreement.
4.4. An administration fee of CHF 20.00 per case is charged for processing fines, traffic violations or official vehicle-owner enquiries. The Lessee bears the actual fine or fee.
5. Insurance and liability
5.1. All vehicles are fully comprehensive insured. The deductible is CHF 1,500 per damage event; several independent instances of damage are each treated as a separate damage event.
5.2. The Lessee is liable for all damage occurring during the rental period that is not covered by insurance, as well as for traffic violations. This applies in particular to damage resulting from gross negligence, alcohol or drug influence, and to damage caused by drivers not listed in the rental agreement; such damage is fully borne by the Lessee.
5.3. The Lessee undertakes to treat the vehicle with care and to observe all legal regulations.
5.4. In the event of an accident or damage, the Lessee must immediately inform the Lessor and the police and complete an accident report.
5.5. If the vehicle keys are lost, the Lessee will be charged for replacement keys and, if applicable, a replacement locking system, at cost price.
6. Use of the vehicle
6.1. The vehicle may only be driven by the Lessee or by drivers named in the rental agreement.
6.2. The Lessee may not use the vehicle for the following purposes:
- Participation in motorsport events
- Transport of hazardous goods
- Subletting or lending to third parties
- Use for illegal activities
- Commercial passenger transport without the Lessor's prior written consent
- Off-road driving outside paved roads
- Towing without the Lessor's prior written consent
6.3. Trips abroad are only permitted with the Lessor's prior written consent; permitted countries are recorded in the rental agreement.
6.4. Smoking and the transport of animals in the vehicle are only permitted with the Lessor's prior consent. Overloading beyond the permitted payload is prohibited.
6.5. The Lessee is obliged to return the vehicle, subject to normal contractual wear, in the condition in which it was received. In the event of exceptional soiling, a cleaning fee of CHF 50 to 150 will be charged depending on effort required.
6.6. The Lessee may not make any technical modifications to the vehicle.
7. Obligations of the Lessee
7.1. The Lessee is obliged to regularly check the vehicle's roadworthiness and to inform the Lessor immediately of any defects.
7.2. The Lessee must bear all traffic and parking violations incurred during the rental period.
7.3. The Lessee must return the vehicle "full to full", i.e. with a full tank as at pickup. Otherwise fuel costs plus a service fee of CHF 20.00 will be charged.
7.4. The Lessee is responsible for securing the vehicle against theft. When leaving the vehicle, all doors and windows must be closed and the vehicle locked.
7.5. Damage to tyres, rims, roof or underbody resulting from improper use (e.g. contact with kerbs, driving on unsuitable terrain) is borne by the Lessee, insofar as not covered by insurance.
7.6. In the event of an incident caused by the Lessee (e.g. accident or improper use), the Lessee bears the towing costs, insofar as these are not covered by insurance, as well as any loss of use of the vehicle for the duration of repairs. In the event of a technical defect through no fault of the Lessee, the Lessor bears these costs.
8. Return of the vehicle
8.1. The vehicle must be returned at the agreed time and location. A late-return fee of CHF 30.00 per hour or part thereof is charged for late return; this covers the additional rental period.
8.2. After unsuccessful attempts to make contact and a written request for immediate return, the Lessor is entitled to take the necessary legal steps and to inform the police.
8.3. The condition of the vehicle is jointly inspected at return and recorded in the handover report (damage list). Damage exceeding normal wear is charged to the Lessee. Damage identifiable at return is documented immediately and communicated to the Lessee.
8.4. The Lessee must return the vehicle clean and in proper condition. In the event of heavy soiling, a cleaning fee will be charged according to section 6.5.
9. Data protection
9.1. The responsible entity for data processing is SS Group GmbH (Malters-Mobility.ch, contact details see section 1.1 of this agreement or the Impressum of the website). The Lessor collects and processes the Lessee's personal data (including name, address, phone number, email, driving licence details) exclusively for the purpose of performing and executing the rental agreement and in accordance with applicable data protection law (Swiss Federal Act on Data Protection, DSG).
9.2. The data will not be disclosed to third parties unless required for the performance of the agreement or by law.
9.3. The Lessee has the right to request, free of charge, information about the personal data stored about them. Further information on data processing is available on request at info@malters-mobility.ch.
10. Changes to the Terms and Conditions
10.1. The Lessor reserves the right to change these Terms and Conditions for future rental relationships at any time. For an already concluded rental relationship, the Terms and Conditions accepted at the time of conclusion always apply.
11. Final provisions
11.1. Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions remains unaffected.
11.2. Swiss law applies. The mandatory statutory jurisdictions apply. Insofar as a choice-of-forum agreement is permissible, Malters LU is the place of jurisdiction.
